These Terms of Use govern your use of the BaseCommerce website (BaseCommerce.6amtech.com) and the BaseCommerce mobile application (together, the "Platform"). By installing, downloading, or using the Platform, you agree to be bound by these Terms of Use. Other policies, including our Cancellation & Refund Policy and Privacy Policy, also apply to your use of the Platform. You must be a natural person of at least 18 years of age, or a corporate entity with authority to bind that entity, to use the Platform.

Use of Platform and Services

The commercial and contractual terms for the sale of goods or services are agreed solely between the Buyer and the Merchant. BaseCommerce acts as a facilitator and does not control, and is not involved in, the offering or acceptance of such commercial terms. BaseCommerce is not responsible for any non-performance or breach of contract between Buyers and Merchants.

• The goods provided by the shops or restaurants including, but not limited to, serving of food orders suiting your requirements and needs;
• The Merchant's goods not being up to your expectations or leading to any loss, harm or damage to you;
• The availability or unavailability of certain items on the menu;
• The Merchant serving the incorrect orders.

Details, price lists, and product images on the Platform are based on information provided by Merchants. BaseCommerce is not responsible for any discrepancies or variations in such information.

Personal Information that you provide

When you create an account, you may provide personal information such as your name, phone number, email, and zip code. You have control over your profile information. Delivery periods stated on the Platform are approximate estimates and may vary. BaseCommerce is not responsible for delays due to seller/merchant issues or unavoidable circumstances. Orders are delivered to the designated address. We reserve the right to cancel or charge additional fees if the delivery location is changed. You are responsible for providing adequate directions and authorizations for delivery. If you fail to accept delivery, the goods may be deemed delivered and no refund will be issued.

You must provide correct credit or debit card details to approved payment gateways. Only lawfully owned cards should be used. BaseCommerce does not store card information but uses third-party providers. Your information is not shared except for fraud verification, or as required by law, regulation, or court order. You are solely responsible for the security of your card. BaseCommerce disclaims liability for unauthorized use. Services are provided during the relevant Merchants' working hours.

Activities Prohibited on the Platform

BaseCommerce reserves the right to investigate and take legal action in respect of any illegal or prohibited conduct on the Platform. The following is a partial list of prohibited activities:

• Using the Platform in violation of any applicable laws or regulations;
• Posting content that infringes intellectual property, privacy, publicity, trade secret, or other rights of any party;
• Posting unlawful, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing content (as determined by BaseCommerce or local community standards);
• Posting content that constitutes cyber-bullying (as determined by BaseCommerce);
• Posting content depicting dangerous, life-threatening, or risky behavior;
• Posting telephone numbers, street addresses, or last names of any person;
• Posting URLs to external websites or any form of HTML or programming code;
• Posting "spam" (as determined by BaseCommerce);
• Impersonating another person;
• Harvesting or collecting information about others, including email addresses, without consent;
• Allowing others to use your identification for posting or viewing comments;
• Harassing, threatening, stalking, or abusing any person;
• Engaging in conduct that restricts or inhibits others from using or enjoying the Platform, or that exposes BaseCommerce, its customers, suppliers, or other parties to liability or detriment;
• Encouraging others to engage in any of the above prohibited activities.

BaseCommerce reserves the right but is not obligated to: investigate allegations that content does not conform to these Terms of Use and determine whether to remove such content; remove abusive, illegal, or disruptive content, or content that fails to conform with these Terms of Use; terminate your access upon breach of these Terms of Use; monitor, edit, or disclose any content; and edit or delete any content regardless of whether it violates these standards.

Amendments

BaseCommerce reserves the right to change or modify these Terms (including any incorporated policies) at any time by posting the changes on the Platform. You are recommended to read the terms regularly. Your continued use of the Platform after changes are posted constitutes your agreement to the amended Terms.

Payment

BaseCommerce reserves the right to offer additional payment methods or remove existing ones. Online payments are processed by third-party service providers. With your consent, card or payment information may be stored by such third-party providers for future orders; BaseCommerce does not store card information itself. You must ensure that you have sufficient funds or credit for your transactions. BaseCommerce takes responsibility for payments, including refunds, chargebacks, cancellations, and dispute resolution, where reasonable and justifiable.

Cancellation

BaseCommerce can cancel any order at any time due to the unavailability of foods or products, delivery outside the coverage area, or any other unavoidable circumstances.
